These Terms of Sale ("Terms") govern your purchase and use of in-app products, subscriptions, or services ("Products") offered through the Word Cloud Trivia mobile application ("App"). By making a purchase in the App or interacting with our Products, you agree to be bound by these Terms. If you do not agree with these Terms, do not make any purchases or use the Products. These Terms also apply to limited interactions with the App without a purchase, unless otherwise specified.

1. General

Word Cloud Trivia is owned and operated by Word Cloud Trivia LLC ("we," "us," or "our"). These Terms apply to all purchases made through the App, including one-time purchases, subscriptions, or other in-app transactions. All purchases are processed through the applicable platform (e.g., Apple App Store, Google Play Store) or, in some cases, a third-party payment processor, and are also subject to their respective terms and conditions. By using the App, you also agree to our Privacy Policy, which explains how we handle your personal information.

1.1 Definitions

1.2 About Digital Products

The App offers free Daily Challenges to all users. Premium features, including access to archived challenges and word cloud flashcards bundled by topic, are available through one-time purchases or subscriptions. One-time purchases provide access to specific bundles of archived challenges or flashcards, while subscriptions (monthly or annual) grant access to all archived challenges and flashcards. We reserve the right to modify the content, type, or availability of any Digital Product at any time. If you do not agree to such modifications, you may cancel your subscription as described in Section 2.1. Digital Product access is typically available within 24 hours of purchase, subject to payment verification. Only one person may use the account credentials associated with a Digital Product.

1.3 Processing and Payment

We process purchases as promptly as possible, but there may be delays while payment details are verified. We accept payment methods offered by the platform (e.g., credit cards, digital wallets) or third-party payment processors (e.g., Stripe, PayPal). Accepted payment methods vary by location. By providing payment information, you confirm its validity. We may receive updated payment information from your payment provider to prevent service interruptions, but you may opt out of this service through your payment provider. If a payment is declined or revoked, we may suspend or terminate access to the Product.

In some cases, we use third-party payment processors ("Third-Party Payment Processors") to bill you through your linked payment account. Payment processing is subject to the processor’s terms and privacy policies in addition to these Terms. We are not responsible for errors by Third-Party Payment Processors. By purchasing a Product, you authorize us, through the processor, to charge your selected payment method and agree to make payment using that method. We may correct processor errors even after payment is requested or received.

1.4 Pricing

Prices for one-time purchases and subscriptions are displayed in the App in the currency applicable to your location and do not include taxes unless otherwise stated. Prices and billing frequency (e.g., monthly or annual for subscriptions) are confirmed at the time of purchase. Prices may change, but changes will not affect completed purchases. Discounts or promotions are applied at the time of purchase and cannot be applied retroactively. If a price is displayed in error, we may cancel or refuse the purchase and notify you to offer a refund or the correct price. Additional fees (e.g., telecommunications or data charges) may apply when using the App, and you are responsible for these costs.

1.5 Promotions

We may offer promotional trials, discounted subscriptions, or referral programs ("Promotions"). Promotion terms will be specified at the time of the offer and may not be combined. For free trials, you must provide payment details to ensure uninterrupted access post-trial. Your subscription will automatically convert to a paid subscription at the end of the trial unless canceled as per Section 2.1. For promotional rates, you will be charged the promotional rate for the specified period, after which the standard rate applies unless canceled. You may only use one free trial or promotional rate per account unless otherwise stated.

For referral programs, eligible users may earn benefits (e.g., discounts or credits) by inviting new users to purchase a subscription. Benefits are non-transferable, non-redeemable for cash, and subject to verification. We may withhold, expire, or modify benefits if we determine your participation is fraudulent, illegal, or violates these Terms.

1.6 Taxes

You are responsible for any applicable taxes, duties, or similar governmental assessments. In some jurisdictions, the platform may collect taxes on our behalf.

1.7 Currency and Location

Prices may vary by region and are displayed in the local currency for your location. Exchange rates and platform policies may affect final pricing.

1.8 Errors

If we discover an error in pricing or product descriptions, we may cancel the purchase and issue a refund or offer you the opportunity to purchase at the correct price.

1.9 No Physical Delivery

All Products are digital and delivered electronically within the App; no physical delivery occurs.

1.10 License for Licensed Content

When you purchase Licensed Content, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Licensed Content for personal, non-commercial use within the App, subject to these Terms and the Terms of Service. You may not reproduce, distribute, publicly display, create derivative works from, or otherwise exploit Licensed Content without our prior written consent.

2. Subscription Terms

2.1 Managing, Canceling, and Renewing Subscriptions

Subscriptions renew automatically unless canceled before the renewal date. You can manage or cancel subscriptions through your Apple App Store or Google Play Store account settings (not through Word Cloud Trivia). If you cancel, you will retain access until the end of the current billing period. No prorated refunds are provided for unused portions of a subscription period unless required by law.

2.2 Subscription Access

Subscriptions (monthly or annual) grant access to all archived challenges and flashcard bundles available at the time and as added over time, subject to these Terms. We may change subscription offerings, content included, or benefits at any time.

2.3 Free Trials

If offered, free trials convert automatically to a paid subscription unless canceled before the trial ends. Trial eligibility and length are determined at the time of offer and may be limited to one per account unless otherwise stated.

3. One-Time Purchases

One-time purchases provide access to specific bundles of archived challenges or flashcards as described in the App at the time of purchase. Access is subject to payment verification and platform policies.

4. Refunds and Returns

Because Products are digital, all sales are final to the fullest extent permitted by law. Refunds are governed by the platform (Apple/Google) and their applicable refund policies. If you believe you were charged in error, contact the platform first. You may also contact us at support@wordcloudtrivia.com, and we will try to assist where possible, but we cannot guarantee refunds processed by the platform.

5. Account and Access

Purchases are tied to the account and platform identity used at purchase time. You are responsible for maintaining access to your platform account. Restoring purchases may require using the same Apple ID/Google account that made the purchase.

6. Prohibited Use

You may not share, resell, transfer, or otherwise provide access to Products to others. You may not copy, screenshot, scrape, or extract Licensed Content, including using it for training or operating machine learning or AI systems.

7. Disclaimers

Products are provided “as is” to the fullest extent permitted by law. We do not guarantee uninterrupted access or that Products will be error-free.

8. Limitation of Liability

To the fullest extent permitted by law, Word Cloud Trivia will not be liable for indirect, incidental, special, consequential, or punitive damages related to Products. Our total liability is limited to the amount you paid for the Product in the prior 12 months.

9. Termination

We may suspend or terminate access to Products if you violate these Terms or the Terms of Service. Upon termination, your license to access Licensed Content ends.

10. Governing Law and Disputes

These Terms are governed by the laws of Illinois. Disputes shall be resolved in the courts of Springfield, Illinois.

11. Changes to These Terms

We may update these Terms, posting the revised version in the App with an updated "Last Updated" date. If changes materially affect your obligations or reduce our obligations, we will notify you at least 30 days in advance. Continued use or purchases after changes constitutes acceptance.

12. Severability

If any provision of these Terms is invalid or unenforceable, it will be severed without affecting the remaining provisions.

13. Entire Agreement

These Terms, our Terms of Service, Privacy Policy, and any additional terms presented at purchase constitute the entire agreement between you and Word Cloud Trivia, superseding prior agreements.
